These Terms govern your use of applications, websites, and services (“Services”) provided by Excitable Robot Publishing LLC (“we,” “us,” “our”). By using our Services, you agree to these Terms.
1. Acceptance
By creating an account or using our Services, you agree to these Terms and our Privacy Policy. If you disagree, do not use our Services.
2. Eligibility
You must be at least 13. Users under 18 need parental consent.
3. Your Account
You are responsible for your credentials, all activity under your account, and providing accurate information. Notify us immediately of unauthorized access.
4. Acceptable Use
Do not:
- Use the Services unlawfully.
- Attempt unauthorized access to any part of the Services.
- Interfere with or disrupt the Services.
- Reverse engineer any portion of the Services.
- Use automated means without written permission.
- Impersonate any person or entity.
5. Your Data
You own your data. We license it only to provide the Services. Export or delete anytime through the app or by contacting us.
6. Health Disclaimer
Our Services are for informational and tracking purposes only — not medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before starting any exercise program. You are solely responsible for your own health and safety when following any training program.
7. AI Coaching Features
HyperIron offers optional AI coaching by allowing you to connect third-party AI chatbots (such as Claude or ChatGPT) to your training data.
- AI-generated coaching suggestions are informational only and should not replace professional guidance from a qualified coach or healthcare provider.
- AI responses are generated by third-party providers (e.g., Anthropic, OpenAI). We do not control, verify, or guarantee the accuracy, safety, or appropriateness of AI-generated content.
- You are responsible for evaluating AI suggestions and deciding whether to follow them. We are not liable for any injury, illness, or adverse outcome resulting from following AI-generated advice.
- The quality of AI coaching depends on the accuracy of the data you provide. Inaccurate inputs may produce unsuitable recommendations.
8. Free Trials & Subscriptions
New accounts receive a free trial period with access to premium features. Free trials do not automatically convert to paid subscriptions — you must actively subscribe to continue premium access after the trial ends.
Paid features are billed in advance, monthly or annually. Cancel anytime through your app store. Refunds follow app store policies. We may adjust pricing with reasonable notice.
9. Intellectual Property
All software, designs, and content are owned by Excitable Robot Publishing LLC and protected by intellectual property laws.
10. Termination
We may suspend or terminate access for Terms violations. You may request data export within 30 days of termination.
11. Disclaimer
The Services are provided “as is” without warranties of any kind. We do not warrant uninterrupted, error-free, or secure operation.
12. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed amounts you paid us in the preceding 12 months.
13. Indemnification
You agree to indemnify Excitable Robot Publishing LLC from claims arising from your use of the Services or violation of these Terms.
14. Governing Law
Governed by the laws of the State of California, without regard to its conflict of law provisions.
15. Disputes
Disputes will be resolved through good-faith negotiation, then binding arbitration administered by JAMS in California. Either party may seek equitable relief in court.
Class action waiver: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against us.
16. Changes
We may modify these Terms. Material changes will be posted here and, where possible, communicated in-app. Continued use constitutes acceptance.
17. Severability
If any provision is unenforceable, the rest remain in effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Excitable Robot Publishing LLC regarding the Services and supersede all prior agreements and understandings.
